Prop 64, “The Adult Use of Marijuana Act”, which was passed recently in California will allow most people with marijuana offense to either completely clear thier conviction from their record, reduce their conviction to a misdemeanor or to an infraction.

1. Clearing or reducing your California Marijuana Conviction under Prop 64.
Many marijuana convictions or offenses can ve cleared and removed completely from your criminal record becase of Prop 64. Although, the process is not automatic. If you have a higher degree offense your conviction will get reduced and show up as lower degree offense on your background checks. If your offense is cleared from your criminal record through Prop 64, then your conviction will not appear on the background checks.

2. What kind of offense are eligible for clearing, sealing and/or reducing under Prop 64.
Possession of NOT more than 1 ounce of marijuana or NOT more than 4 grams of concentrate(oil/rosin/hash):
Possession by an adult over the age of 21 used to be a $100 ticket and now anyone with this offense may have it removed from thier record completely. If you were underage, you may have it reduced to an infraction refer Health and Safety code 11357.
If you were ticketed in a school or campus premises, the offense may not be completely removed from your record. Although you have the option to reduce it to a misdemeanor if you are over 21, to an infraction if you are under 21.
Possession of MORE than 1 ounce of marijuana or MORE than 4 grams of concentrate (oil/rosin/hash):
Possession of concentrate (oil/rosin/hash) by an adult over the age of 21 used to be a misdeameanor or a felony and now anyone with this offense may have it reduced. You have the option to reduce it to a misdemeanor if you are over 18, to an infraction if you are under 18.
Cultivation of LESS than 6 marijuana plants:
This offense used to be a felony and now anyone with this offense may have it removed their record completely. If you were under 21 during the offense you will be able to reduce it to an infraction.
Cultivation of MORE than 6 marijuana plants:
This offense used to be a felony and now anyone with this offense may have it reduced to a misdemeanor (unless you have prior offense similar to this one) . If you were under 21 during the offense you will be able to reduce it to an infraction.
Possession of Marijuana for sale:
This offense used to be a felony and now anyone with this offense may have it reduced to a misdemeanor if it is their first or second offense in California for most cases . If you were under 21 during the offense you will be able to reduce it to an infraction.
Transportation of Marijuana for sale and illegal gifts OVER 28.5 grams of marijuana or any amount of concentrate:
This offense used to be a felony and now anyone with this offense may have it reduced to a misdemeanor offense in California for most cases . If you were under 21 during the offense you will be able to reduce it to an infraction.
Transportation of Marijuana for sale and illegal gifts under 28.5 grams of marijuana (NO CONCENTRATE):
This offense used to be a felony and now anyone with this offense may have it reduced to a infraction in California for most cases.
3. Is Prop 64 still useful to you if you already cleared or reduced your conviction?
Yes, the usual record clearing law (a 1203.4) was designed only for employment purposes and it will not remove the case entirely from your criminal record. Prop 64 maybe able to remove the case entriely from your crminal record and give you complete relief which was never available before for anyone who was convicted of an offense. Also, you maybe able to restore your Second Amendment rights to bear arms if you are eligible for reduction under Prop 64.
The Proposition 64, Adult Use of Marijuna Act (AUMA), not only legalizes marijuana for recreational use but also creates a benefit for many people who have been marginalized for several years based on severly minor offenses which had very hard punishments.
